Charges dropped in
shooting case
All charges have been dropped against a man accused of shooting someone in the face last spring because witnesses recanted their statements, court records indicate.
District Court Judge Christopher Polking dismissed the charges against Dontay B. Diekman, 42, of Fort Dodge, in response to a motion filed by the Webster County Attorney’s Office. In the motion, prosecutors wrote that the dismissal was in the interests of justice and that “all witnesses have recanted.”
Diekman had been charged with attempted murder, dominion or control of a firearm by a felon and going armed with intent.
Polking dismissed the charges on July 17. Diekman was released from the Webster County Jail.
He had been accused of shooting a man who was sleeping on the floor of a residence at 1433 Fourth Ave. S. in the early morning hours of March 28. In criminal complaints filed against him, Fort Dodge police detectives wrote that Diekman had been in the residence talking with some other people when he went over to the man sleeping on the floor and fired one round at him.The bullet struck the man’s jaw and exited through his mouth, the detectives wrote. Diekman then left the residence.
The man survived the shooting.
Diekman was arrested in Des Moines on April 11.
Badger man pleads
to child porn charge
BADGER– A Badger man has pleaded guilty to a federal child pornography charge, according to prosecutors.
Kenneth Brown, 60, pleaded guilty Tuesday to one count of possession of child pornography, the U.S. Attorney’s Office for the Northern District of Iowa reported.
According to the Attorney’s Office, Brown admitted to receiving and possessing child pornography between May 2023 and April 3, 2024. Prosecutors said 32 files of child pornoraphy were uploaded to the internet from Brown’s cell phone.
An examination of the phone revealed 27 videos and 28 images of child pornography which included prepubescent children and toddlers. The material included sadistic and masochistic conduct, prosecutors said.
Brown remains in the custody of the U.S. Marshal’s Service, awaiting sentencing.
