FD man pleads guilty to federal firearms offense

A Fort Dodge man has pleaded guilty to a federal gun charge, according to the U.S. Attorney’s Office for the Northern District of iowa.

Daniel Smith, 38, pleaded guilty to illegal possession of firearms. The plea was made Tuesday in U.S. District Court in Sioux City, prosecutors said.

Smith had been previously convicted in state court of unauthorized possession of offensive weapons, and dominion/control of a firearm by a felon, prosecutors reported.

His most recent firearms related arrest occurred in November 2024.

On Nov. 16, 2024, police went to his home in response to a report of shots fired. There, the officers observed evidence of a shotgun being fired.

Officers returned with a search warrant on Nov. 16, 2024, and seized a .22 caliber rifle, a 410-gauge shotgun and a 16-gauge shotgun, according to federal prosecutors.

Smith was initially charged at the state level with three counts of dominion/control of a firearm by a felon. The case against him was later transferred to federal court.

During the plea hearing, Smth admitted he had received the three weapons and fired two of them to test their functioning.

He remains in custody, awaiting sentencing.
