Second person arrested in break-in, beating incident

A second man has been arrested in connection with a July 4 burglary in which a woman was beaten with a bat or club.

John C. Schlack, 28, of 106 N. 10th St., was arrested by Fort Dodge police on Monday. He faces charges of first-degree burglary and violation of parole, according to court records.

Schlack and two other people reportedly went into an apartment in the 1500 block of Third Avenue North at about 2 a.m. July 4, according to criminal complaints. Once inside, Schlack and another man pinned down the woman who lived in the apartment while another woman beat her with a baseball bat or club, the criminal complaints state.

Schlack made his initial appearance in Webster County Magistrate Court Tuesday morning. Magistrate Sarah J. Livingston scheduled an Aug. 8 preliminary hearing on the first-degree burglary charge. She issued an order prohibiting Schlack from having any contact with the woman.

Livingston set bond on the burglary charge at $25,000 cash only.

The violation of parole charge was referred to the Board of Parole. That board will determine if he should be sent back to prison for violating the terms of the parole upon which he was released.

Schlack is being held without bond on the violation of parole charge.

One of Schlack’s accused accomplices in the attack was arrested Saturday. David S. Dayton, 39, 1609 12th Ave. S.W., is charged with first-degree burglary. He remains in the Webster County Jail on $25,000 cash-only bond.
