FD man arrested for violent break-in
A man has been arrested for reportedly breaking into a Fort Dodge apartment and restraining the resident while someone else beat her with a bat or club, according to court records.
David S. Dayton, 39, 1609 12th Ave. S.W., has been charged with first-degree burglary, court records indicate.
He and two other people are accused of going into an apartment in the 1500 block of Third Avenue North at about 2 a.m. July 4, according to criminal complaints. Once inside, Dayton and another individual pinned down the woman who lived in the apartment while another woman beat her with a baseball bat or club, the criminal complaints state.
Dayton was arrested Saturday in Pocahontas County. He made his initial appearance in Webster County Magistrate Court Monday morning.
Magistrate Sarah Livingston scheduled an Aug. 6 preliminary hearing. She also issued an order directing Dayton to have no contact with the woman.
Livingston set bond for Dayton at $25,000 cash only.
