FD council to consider settlement

The Fort Dodge City Council will consider settling a lawsuit for $40,000, with that money being paid by the city’s insurance company, when it meets tonight.

The council will also consider awarding a contract for a building project at Harlan and Hazel Rogers Sports Complex.

The council’s evening will begin at 5 p.m. in the Municipal Building, 819 First Ave. S., with a workshop on Dodger Area Rapid Transit bus operations.

At 5:30 p.m. the council will move into a closed door session regarding the proposed settlement. The Iowa Open Meetings Law does allow such closed door meetings to enable public bodies to meet privately with attorneys regarding pending litigation.

The council’s regular business meeting will begin at 6 p.m.

The council is scheduled to vote on the settlement during that public session.

The proposed motion the council will vote on describes the settlement as “recommended by and paid by the city’s insurance carrier solely to avoid the costs, expenses and attorney fees of ongoing litigation and not because there was any wrongdoing on the part of the city, any officer or anyone else with the city.”

No other information about the settlement is included in the documentation accompanying the council agenda.

Also during the meeting, the council will consider awarding a contract for building a second story press box onto the existing concession stand in the mini majors section of Harlan and Hazel Rogers Sports Complex.

Giardino Construction, of Polk City, submitted the apparent low bid of about $478,000.
