Defense filed new brief for new trial

A Fort Dodge man awaiting sentencing for first-degree murder will have to wait until 2025 to learn his fate.
Isaac Bachman was scheduled for sentencing Thursday afternoon in Webster County District Court. He faces life in prison without the possibility of parole for the June 2023 shooting of 14-year-old Dakari James. Bachman was found guilty of first-degree murder by a jury on Oct. 31.
Bachman’s attorney, Judd Parker, electronically filed a new legal brief at 1:25 a.m. Thursday requesting a new trial. In the brief, Parker stated that jury instructions were incorrect and that after contacting jurors following the trial, he believed statements made by the prosecutors had prejudiced the jury. Parker also explained in the brief that Bachman had claimed self-defense in the case.
Webster County Assistant County Attorney Bailey Taylor told Judge Christopher Polking Thursday that the state had not yet had time to read the brief filed 10 hours prior to the hearing or to research the statements made and find the transcripts noted in the brief.
The early morning brief filed Thursday was the second one seeking a new trial to be filed by Parker, who had also made a motion on Nov. 30.
Polking continued the hearing to Jan. 10, 2025, to allow the state the opportunity to read and research the brief.
Sentencing may happen at the Jan. 10 hearing, dependent upon the court’s ruling on the motion.
