ROCKWELL CITY -- A Pomeroy man set to go to trial later this month for the April 2022 shooting death of his brother has waived his right to a jury trial, instead asking that the case be heard and decided by a District Court judge.
Michael Kenneth Hinners, 57, was arrested April 9, 2022, at his home at 210 S. Ontario St. in Pomeroy after law enforcement arrived and found his brother, 59-year-old Anthony Hinners, laying in the yard with a gunshot wound. Michael Hinners was taken into custody and charged with first-degree murder, a Class A felony.
Michael Hinners is scheduled to go to trial May 9. On Friday, he filed a waiver of a jury trial. After this waiver, Hinners' fate will be determined by a single District Court judge rather than a jury of 12 of his peers.
According to court records, the day of the shooting, the two brothers had been arguing about a car that would not start. Michael Hinners was standing on the front porch and allegedly pointed a 10-gauge shotgun at Anthony Hinners, who was at the bottom of the steps, and fired, hitting him once in the chest.
Anthony Hinners was pronounced dead at the scene.
