Shivers gets 20 years for 2021 robbery

A Fort Dodge man who pleaded guilty to his role in a January 2021 armed robbery in the Coleman District was sentenced to up to 20 years in prison by Webster County District Court Judge Thomas Bice on Monday.

In April, Davaris Jamel Shivers, 18, pleaded guilty to an amended charge of second-degree robbery, a Class C felony, and one count of possession of a firearm by a prohibited person, a Class D felony. Remaining counts of going armed with intent, first-degree burglary and carrying weapons were dismissed.

On Monday, Bice sentenced Shivers to up to 10 years for the robbery charge and up to 5 years for the firearm charge. Shivers received an additional five-year sentence for a charge of second-degree criminal mischief that stemmed from damage Shivers did to a panel in the padded cell at the Webster County Jail on Feb. 17 of this year.

All three sentences are ordered to be served consecutively and no mandatory minimum was imposed.

A series of unrelated misdemeanors were also dismissed at the sentencing.

According to court documents, Shivers and two other men forced their way into an apartment in the 2000 block of South 12th Street around 8 a.m. on Jan. 4, 2021, with the intent to rob the occupants. During the robbery, one of the other men involved shot at a resident of the apartment, Benjamin Myer, hitting him in the abdomen. The suspects fled the scene, leading Webster County Sheriff’s Office deputies on a short pursuit.

Co-defendants Tyler Rosburg and Ashton Lomicka accepted plea deals in October.

Rosburg, 29, pleaded guilty to one count of first-degree robbery, a Class B felony; one count of possession of a firearm as a felon, a Class D felony; and one count of eluding, a serious misdemeanor. He has been sentenced to up to 25 years in prison with a mandatory minimum of 50%.

Lomicka, 23, pleaded guilty to one count of second-degree robbery. He was sentenced to up to 10 years in prison, with a mandatory minimum of 70%.
