Rosburg pleads guilty

A Fort Dodge man has pleaded guilty to charges stemming from a Jan. 4 armed robbery that sent a man to the hospital with a gunshot wound.

Tyler William Rosburg, 29, pleaded guilty to one count of first-degree robbery, a Class B felony; one count of possession of a firearm as a felon, a Class D felony; and one count of eluding, a serious misdemeanor; on Sept. 28.

Rosburg was arrested Jan. 4 following a chase after the Webster County Sheriff’s Office responded to a man suffering from a gunshot wound in the Coleman District. Deputies were responding to the scene at 2055 S. 12th St., when the victim told deputies that two white males and one black male forced their way into his home with firearms. He identified one as Rosburg and said all three left in a white Chevrolet HHR.

Within minutes of the call, Chief Deputy Derek Christie spotted a vehicle fitting the description traveling west on 11th Avenue Southwest and attempted to stop it. The driver of the vehicle refused to stop, leading Christie on a short pursuit through Fort Dodge before the Chevrolet crashed on the Hawkeye Avenue Bridge near its intersection with Second Street Northwest.

Rosburg was initially charged with the offenses he eventually pleaded guilty to, as well as others.

The charges of intimidation with a dangerous weapon to injure or provoke fear, going armed with intent and first-degree burglary were dismissed.

According to the plea agreement, both the state and the defense recommend a total indeterminate sentence of incarceration up to 25 years with a 50% mandatory minimum. The robbery charge would carry the indeterminate 25-year sentence with a 50% mandatory minimum, which would be served concurrently with a five-year indeterminate sentence for the firearm possession charge and one-year sentence for eluding.

Rosburg’s sentencing is scheduled for Nov. 1 at the Webster County Courthouse.

Rosburg was set to go to trial on Sept. 28.

The other two men charged with the Jan. 4 robbery were 22-year-old Ashton Jack Lomicka, of Fort Dodge, and 17-year-old Devaris Jamel Shivers, of Fort Dodge.

Lomicka also took a plea deal last week. As of Sept. 20, Shivers has a warrant out for his arrest for failing to appear at a pretrial conference.
