Third January robbery defendant pleads not guilty

A third Fort Dodge man accused of a Jan. 4 home invasion and robbery has pleaded not guilty to the charges stemming from that incident.

Ashton Jack Lomicka, 22, entered his not guilty plea in Webster County District Court on Tuesday. He is facing charges of:

• First degree robbery, a Class B forcible felony

• Going armed with intent, a Class D felony

• Possession of a firearm by a prohibited person, a Class D felony

• First-degree burglary, a Class B forcible felony

• Carrying weapons, an aggravated misdemeanor

His trial is scheduled for Sept. 14.

According to the criminal complaint from the Webster County Sheriff’s Office, Lomicka, along with Tyler Rosburg, 29, and Davaris Shivers, 17, broke into a home on the 2000 block of South 12th Street around 8 a.m. on Jan. 4. All three suspects were armed with handguns and intended to commit theft at the residence, the complaint said.

The three held an occupant of the home at gunpoint and demanded money from him while going through his pockets, according to the complaint..

When the three fled the scene, Rosburg fired a round at the victim, striking him in the abdomen and causing injury, the complaint stated.

Rosburg was charged with:

• First-degree robbery

• Possession of a firearm as a felon as a habitual offender, a Class D felony

• Eluding, an aggravated misdemeanor

• Intimidation with a dangerous weapon as a habitual offender, a Class C felony

• Going armed with intent as a habitual offender, a Class D felony

• First-degree burglary

Rosberg pleaded not guilty to his charges and is scheduled to go to trial on Sept. 14.

Shivers is charged with:

• First-degree robbery

• Possession of a firearm as a prohibited person

• Going armed with intent

• First-degree burglary

• Carrying weapons.

Shivers has also pleaded not guilty to his charges and will go to trial on Sept. 28.
