Warden developer asks for more time

City leaders to consult with attorney

Fort Dodge officials, frustrated with a lack of information from the developer that proposed the stalled renovation of the Warden Plaza, will consider their legal options for taking the building back.

The city sent KDG LLC, of Columbia, Missouri, a certified letter asking for an update by the end of the day Friday.

The developer responded by asking for more time to respond to the city’s letter, according to Mayor Matt Bemrich.

”All indications point to moving to take the building back if they don’t come forth with something better than we need more time,” Bemrich said.

The council will meet in a private session Monday with City Attorney Mark Crimmins to discuss the situation. Iowa’s open meetings law allows governing bodies to hold such closed-door meetings to get legal advice on pending litigation.

The City Council gave the building at 908 First Ave. S. to the developer in December 2016 after going to court to take it from its previous owner, Corale LLC, of Oakland, California, under the terms of the state’s abandoned buildings law.

The plan for the site calls for retail space on the first two floors and about 100 apartments on the upper floors.

A rejuvenated Warden Plaza was envisioned as one element of a transformation of the 900 block of First Avenue South that would also include a new cultural and recreation center and a parking garage with additional features called an intermodal hub.
