Prosecutor: Deputy acted lawfully

MUSCATINE (AP) – An Iowa prosecutor said a sheriff’s deputy acted lawfully when he shot a man after a car chase earlier this month.

Muscatine County Attorney Alan Ostergren released his decision Wednesday in the case involving Louisa County Sheriff’s Deputy David Perley.

Authorities said Perley shot Richard Spurling in the upper torso on June 9 after pursuing him from Louisa into Muscatine County. Spurling is accused of driving his vehicle toward the deputy, at which point Perley fired one shot.

Spurling was treated at a hospital for his injuries and later released. The Iowa Division of Criminal Investigation reviewed the shooting and shared its findings with the Muscatine County attorney’s office.

Authorities said in an initial report that Spurling faces several charges, including operating a motor vehicle while intoxicated.
