Fort Dodge man pleads not guilty to burglary, theft, drug charges

A Fort Dodge man has pleaded not guilty to an array of felony charges in Webster County District Court.

Ashton Jack Lomicka, 22, entered his not guilty pleas on Monday. He is facing charges of:

• First-degree burglary, a Class B forcible felony

• First-degree theft, a Class C felony

• Possession of methamphetamine with intent to deliver, a Class B felony

• Possession of a firearm as a felon, a Class D felony

• Operating a vehicle without the owner’s consent, an aggravated misdemeanor

For the burglary, theft and meth charges, Lomicka waived his right to a speedy trial within 90 days of the filing of the trial information. Because of this, his trial for these charges is scheduled for Sept. 14.

For the charges of firearm possession and operating a vehicle without owner’s consent, Lomicka did not waive his right to a speedy trial and his trial is scheduled for July 13.

According to the criminal complaints, Lomicka is accused of breaking into a home in the 1700 block of 320th Street near Gowrie on April 5. According to the criminal complaint, a 13-year-old girl was in the home when the burglary happened.

Through investigation and viewing surveillance footage, Webster County sheriff’s deputies were able to identify Lomicka as a suspect. According to the criminal complaint, Lomicka stole 190 ounces of silver valued at $6,447, $3,500 in cash, Dewalt tools valued at more than $3,000, a rifle with a scope and a .410-caliber long gun.

On April 8, the Webster County/Fort Dodge Special Emergency Response Team executed a search warrant at 1338 Third Ave. N.W. Lot 67, where they arrested Lomicka.

During the search of the residence, officers located and seized a firearm, ammunition, currency, paraphernalia, suspected narcotics, electronic devices and other items related to the case.

Court documents show that officers found “well over” 5 grams of a crystal substance believed to be methamphetamine, small unused plastic bags, a large amount of cash and a working digital scale on Lomicka’s person.

In a separate incident on April 4, Lomicka allegedly took possession of another Gowrie man’s vehicle without his permission and kept it for two days, using it in the commission of criminal offenses.

Lomicka is being held at the Webster County Jail on a $76,000 cash-only bail.
