Gilmore City man pleads guilty to filing false tax returns, theft

GILMORE CITY — A Gilmore City man pleaded guilty to six different counts in federal court after stealing over $156,000 through his tax return preparation business, according to the U.S. Attorney’s Office.

David Miller, 52, pleaded guilty to three counts of aiding and assisting in the preparation of false and fraudulent income tax returns and three counts of receiving stolen government money or property. Miller will be required to pay all of the stolen money back to the IRS.

In a plea agreement, Miller admitted to preparing fraudulent income tax returns through his tax prep business between tax years 2012 and 2015, depriving clients of part of their tax refund as a result of theft.

Miller stole money belonging to the U.S. government through 39 partial client tax refunds from 2014 to 2016. He also failed to report the stolen funds as income, resulting in additional tax obligations for himself totalling nearly $31,000 from 2011 to 2016.

Miller faces a maximum combined sentence of 13 years in prison and a fine of up to $350,000 in the case, prosecuted by Assistant U.S. Attorney Ron Timmons.

Sentencing in the U.S. District Court will be set after a presentence report is prepared. Miller remains free on bond until then.
